These terms apply to your use of the Fluff Mallows website and to any order you place with us. Please read them before you buy.

By using this website or placing an order, you agree to these terms. If you do not agree, please do not use the site.

In these terms, "we", "us" and "our" mean Fluff Mallows. "You" means the person using the site or placing an order.

Who we are and where we sell

Fluff Mallows is a food business operating in Ontario, Canada. We sell and ship within Ontario only. We do not accept orders for delivery outside Ontario.

Eligibility

You must be at least the age of majority in Ontario, or have the permission of a parent or guardian, to place an order.

By placing an order you confirm that the information you give us is accurate and that you are authorised to use the payment method you provide.

Products and product information

We work hard to describe our products accurately, but please note:

• Photographs are illustrative. Colour, size, shape and texture vary naturally between batches and may differ from images on the site.
• Screen settings affect how colours appear.
• Product descriptions, ingredients and allergen information may change. Always read the label on the package you receive, as it is the authoritative source.

Allergen information is shown on each product page and on the packaging. If you have a food allergy or intolerance, please read the label on the product before eating it. If a product reaches you with incorrect or missing allergen information, stop eating it and contact us immediately. This is covered by our Return and Refund Policy.

Orders

Your order is an offer to buy. A contract is formed only when we send you an order confirmation or dispatch your order, whichever happens first. An automated acknowledgement that we have received your order is not acceptance.

We may refuse or limit any order, including where:

• The product is out of stock or no longer available
• We suspect fraudulent or unauthorised activity
• We cannot deliver to the address given
• There has been an error in pricing or product information
• The order is for resale without our agreement

If we refuse an order after you have paid, we will refund you in full to your original payment method.

Pricing and payment

All prices are in Canadian dollars and exclude shipping and applicable taxes unless stated otherwise. Taxes and shipping are shown at checkout before you pay.

Despite our best efforts, a product may occasionally be listed at an incorrect price. If we discover a pricing error on an order we have accepted, we will contact you, and you may either confirm the order at the correct price or cancel it for a full refund. We will not charge you the higher price without your agreement.

Payment is taken at checkout through our payment provider. We do not store your card details.

Shipping and delivery

Delivery timeframes given on the site are estimates, not guarantees. We are not responsible for carrier delays outside our control.

Risk in the products passes to you on delivery to the address you provided.

Fluff Mallows are a soft confection and are sensitive to heat. Please arrange to receive your order promptly and bring it indoors on arrival. Softening or minor change of shape caused by warm weather in transit is normal and is addressed in our Return and Refund Policy.

Storage and use

Please store products as directed on the packaging and consume them by the best-before date. We are not responsible for product quality issues caused by improper storage after delivery.

Returns, refunds and cancellations

Our Return and Refund Policy forms part of these terms and sets out when you may request a refund, how to do so, and what remedies are available. Please read it alongside these terms.

Your account

If you create an account, you are responsible for keeping your login details confidential and for activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission.

We may suspend or close an account that we reasonably believe has been used fraudulently or in breach of these terms.

Reviews, photos and other content you submit

If you post a review, photograph, comment or other content to our site or tag us on social media, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with our business, including in marketing. You confirm that the content is yours to share and does not infringe anyone else's rights.

We may remove content that is unlawful, misleading, offensive, or unrelated to our products.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose
• Interfere with or disrupt the site or its security features
• Use automated systems to scrape, copy or harvest content or data
• Attempt to gain unauthorised access to any part of the site or our systems
• Resell our products commercially without our written agreement

Our intellectual property

The Fluff Mallows name, logo, product names, recipes, photographs, text and site design are our property or licensed to us. You may not copy, reproduce or use them commercially without our written permission.

You may share our content on social media in the ordinary way, with credit.

Availability of the site

We aim to keep the site available but do not guarantee uninterrupted access. We may suspend, withdraw or change any part of the site without notice.

Our liability

Nothing in these terms limits or excludes our liability for:

• Personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• The implied conditions and warranties that apply under Ontario's Sale of Goods Act and are protected by section 9 of the Consumer Protection Act, 2002
• Any other liability that cannot be limited or excluded by law

Subject to the above, and to the fullest extent permitted by law:

• We are not liable for indirect, incidental or consequential losses, or for loss of profit, revenue or opportunity
• Our total liability arising from any order is limited to the amount you paid for that order

We provide the website itself on an "as is" basis and do not warrant that it will be error-free.

Events outside our control

We are not liable for failure or delay in performing our obligations where that failure or delay results from an event outside our reasonable control, including extreme weather, carrier disruption, supply shortages, power or network failure, or public health measures.

Where such an event occurs, we will contact you and either extend the delivery timeframe or, if you prefer, cancel the order and refund you.

Links to other sites

Our site may link to third party websites. We do not control them and are not responsible for their content or practices.

Privacy

Our Privacy Policy explains how we collect and handle your personal information. It forms part of these terms.

Changes to these terms

We may update these terms from time to time. The version in force is the one published on this page at the time you place your order. Changes do not apply retroactively to orders already accepted.

Governing law and where disputes are heard

These terms are governed by the laws of Ontario and the federal laws of Canada that apply in Ontario.

Any dispute may be brought in the courts of Ontario. Nothing in these terms prevents you from bringing a claim in the Ontario Small Claims Court, from making a complaint to a regulator, or from exercising any right you have under the Consumer Protection Act, 2002.

If part of these terms cannot be enforced

If any provision of these terms is found to be unenforceable, the rest of the terms continue to apply.
